Gibbon, Neb., man charged in fatal crash

KEARNEY, Neb. (AP) - A Gibbon man has been charged with felony motor vehicle homicide for his role in a November crash that left a rural Wood River man dead.

Authorities say 35-year-old Jose Murillo-Avina was driving on U.S. Highway 30 on Nov. 22 when his vehicle collided with a car driven by 52-year-old Jerry Codner.

Court records show that Murrilo-Avina told emergency responders that he had had at least six beers before the crash. At the hospital, his blood-alcohol content measured .19. The legal limit to drive in Nebraska is .08.

Because Avina has a previous drunken-driving conviction, the charge he faces in Buffalo County is considered more serious. If convicted, he faces up to 50 years in prison.

He remains free on bond.
