LINCOLN, Neb. (AP) - Nebraskans who belong to homeowners' associations may soon have another reason to pay dues that help keep their neighborhoods tidy.
A bill (LB736) given first-round approval by lawmakers on Tuesday would allow associations to have financial liens on homes for unpaid association dues and fines. Associations' liens could lead to home foreclosure so the unpaid dues could be collected.
Liens for unpaid property taxes and mortgages would take priority over homeowner association liens.
Sen. Pete Pirsch of Omaha says a similar law is in place for condominium associations and that courts have ruled that liens can be used by other types of homeowners' associations.
He says the bill is needed to make state laws clear on the matter.
