Gering man faces 2 felony charges after fatal accident

A Gering man is dead, and a Minatare man is in jail after a roll over accident late Friday night.

The accident happened just south of the intersection of County Road M and County Road 29 on Friday.

A pickup with six occupants (four in the cab, two in the bed) left the roadway and rolled several times.

21-year old Taylor Magdaleno of Gering was ejected and died from the injuries he sustained.

The driver, 21-year old Drew Schmaltz of Minatare, was arrested and charged with driving under the influence and motor vehicle homicide. This is Schmaltz' second DUI arrest.

On Monday, Schmaltz waived his preliminary hearing and was bound over to district court. He is free on 10% of a $100,000 bond, as is due back in court on Friday.

The four other occupants were treated for non-life threatening injuries. Scotts Bluff County Sheriff Mark Overman says that none of the men were wearing seatbelts.
