Less than 24-hours after a judge declares a mistrial... charges are re-filed against a convicted sex offender accused of sexually assaulting a child.
52-year-old Timothy Fuentes will once again stand trial for the alleged sexual assault of a 9-year-old Scottsbluff girl. Prosecutors say the crime happened in August.
Yesterday a jury was unable to reach a verdict after hearing two days worth of testimony.
Prosecutor Doug Warner says he's not sure why jurors were unable to make a decision. "This is a case that needs to be retried," explains Warner. "Just because there's a hung jury, that doesn't signal the end of it. And another 12 people will probably be able to reach a decision."
Warner says this will go to trial during the March jury term, and that Fuentes is still in jail despite yesterday's hung jury.
Fuentes already has multiple convictions in *several* sex crimes against children.
