Gering woman convicted on lesser drug charge

A Gering woman caught with close to a quarter of a pound of high-grade marijuana was found guilty this afternoon in Scotts Bluff County District Court.

26-year-old Nicole Clark was initially charged with Possession with intent to distribute.

During today's trial, Defense Attorney David MacDonald pointed out that there was no evidence - other than the quantity of marijuana- to prove that Clark had any intent of distributing the drug.

Typically, associated paraphernalia; including scales and baggies, would incriminate someone on that charge.

Instead, the jury convicted Clark on a lesser charge of Possession of Marijuana (more than 1 ounce, less than one pound). That crime is a Class III misdemeanor, and carries a jail sentence of up to one year.

Sentencing has been set for August 21st at 4 p.m.
