Gering meth dealer strikes plea deal to avoid going to trial

A Gering man who was arrested in November for allegedly selling methamphetamine out of his home has struck a deal with prosecutors to avoid going to trial.

48-year-old Brad Benavides is expected to plead guilty or no contest to one count of Distribution of a Controlled Substance with Intent to Sell (More than 10 grams, less than 27 grams).

By entering the plea deal, prosecutors will drop two counts of Distribution of a Controlled Substance.

Benavides' Change of Plea Hearing is set for Friday at 1 p.m. in Scotts Bluff County District Court. The Class ID felony carries a prison sentence ranging from 3 to 50 years, and Scotts Bluff County Attorney Doug Warner is seeking more than the minimum prison time.

Also arrested in that November bust was 38-year-old Chatty Maxwell. She is being charged with Possession of a Controlled Substance. Maxwell has pled not guilty, and the case is set to go to trial in the jury term that begins March 3rd.
