Judge rules there is probable cause against man charged in 2008 toddler death

A man charged with the 2008 death of a Gering toddler will stand trial, after a Scotts Bluff County Judge upholds the original indictment.

In March, the attorney for 27- year – old Dustin Chauncey filed a motion to dismiss the indictment and to release the testimony and evidence from grand jury proceedings to prepare for trial.

Judge Leo Dobrovolny ruled that there was probable cause for the charge of “committing intentional child abuse resulting in death”. He stated "a crime was committed and probable cause that Dustin Chauncey committed the crimes of Manslaughter and Child Abuse."

Dobrovolny has yet to rule on the request to release additional grand jury testimony.  

Chauncey is accused of fatally injuring two – year – old Juliette Geurts in July, 2008.

The case is currently scheduled to go to trial the second week of August. If convicted, he would be facing 20 years to life in prison.
