Man who showed up drunk for DUI court date arrested on new charges

Posted: Updated:
The Mitchell man who showed up intoxicated for the jury selection for his own DUI trial in February has more charges filed against him.

58-year-old Robert Bergstedt was arrested on a warrant stemming from a March 30th incident. Court documents say Sheriff's Deputies were dispatched to his Mitchell home because Bergstedt was drunk and had thrown several items at his wife.

When police arrived, they found Bergstedt extremely intoxicated, sitting on an empty bottle of vodka with a blanket over his head. The affidavit says Bergstedt yelled at the officer to get out of his [expletive] house, before dropping a lit cigarette on the living room rug.

When officers attempted to place him an ambulance to be transported the the hospital, officers say he became "completely non-cooperative" and squared off with officers before fleeing on foot. He was apprehended shortly after, and began kicking the patrol vehicle and actively resisted being placed into the unit.

At the hospital, Bergstedt continued to actively resist officers and hospital staff and began to become violent. He had to be physically restrained to allow the hospital staff to do their jobs, and was placed in a spit hood to prevent him from spitting on officers and medical staff.

He is currently charged with obstruction for this incident, as well as the pending DUI charge from November 2012. A jury trial was slated for that charge back in February, but Bergstedt was arrested for contempt after he showed up to jury selection intoxicated.

Deputies say he was transported to Omaha for an alcohol treatment program, but he checked himself out before completion.
