Judge denies new trial for former Mitchell teacher convicted of child sex assault

A Scotts Bluff County District Judge has denied a new trial request made by a former Mitchell teacher convicted last month of 3rd Degree Sexual Assault of a Child.

37-year-old Richard Cobos was back in court this morning with attorney Bell Island to make the motion for a new trial. They claim the court erred in several manners during his trial; including having Scotts Bluff County Attorney Doug Warner call Cobos a 'predator' and not allowing Cobos' alibi to considered by the jury.

District Judge Leo Dobrovolny denied the requests, and upheld the conviction. Cobos is set to be sentenced on June 4th.

Cobos is facing more serious charges in Morrill County that came to light after the initial charges in Scotts Bluff County. In that case, Cobos is being charged with 1st Degree Sexual Assault stemming from an April, 2009 incident involving a girl who was nine-years-old at the time. That case is set to go to trial on May 28th in Morrill County District Court. If convicted on that charge, Cobos could face a prison sentence ranging from 20-years to life.
