State to dismiss charges against Mitchell man caught with 18 ounces of meth

Charges are set to be dropped against the Mitchell man who was caught with more than 18 ounces of methamphetamine in his home in January.

Police were looking for Joseph Lowery during the search, and forced 27-year-old George Valles to open a locked bedroom door, despite not having a search warrant. Judge Leo Dobrovolny ruled last week that the evidence was seized illegally, and is to be suppressed.

Scotts Bluff County Doug Warner says that he agrees with the judge's ruling, and the case is expected to be dismissed during a hearing scheduled for Tuesday afternoon at 2:30.

Valles is still being charged with a separate concealed weapon charge, however that is only a Class I misdemeanor.

Joseph Lowery is still being charged with possession of methamphetamine with intent to distribute, and that is set to go to trial later this month.
