Accused Git N Split robber back in court

Posted: Updated:

The attorney for the man accused of robbing a Scottsbluff gas station earlier this year says that some of the evidence in the case should not be used.

28-year-old Michael Galindo is charged with one felony robbery count in connection to a robbery that occurred on January 15, 2014 at the Git N Split on 27th Street.

Today during a suppression hearing, defense attorney William Madelung argued that the search warrant issued on a 7th Avenue home was issued in error. He says that items found on Galindo after he was arrested were to vague to be linked to the man caught on surveillance camera at the store. When Galindo was arrested, officers found a light blue bandanna, three $50 bills, and a white latex glove- all of which were linked to the robbery.

District Judge Randall Lippstreu says he will take the suppression motion under advisement and decide in the coming days if the evidence should be suppressed.

Currently, a trial is scheduled for later this month in Scotts Bluff County District Court, but a motion for a continuance has been filed.
